- Sending a Preservation Letter: A preservation letter is a written request that certain documents, electronically stored information and data, and vehicles be preserved in anticipation of future litigation. Although demands to preserve evidence may be onerous and burdensome, it is important to begin collecting this evidence as soon as possible. The more time that passes before a suit is filed, the more difficult it will be to retrieve the necessary evidence for the motor carrier’s defense. When a motor carrier receives a preservation letter, any response should be in writing to ensure that the discussions are memorialized and that there is no confusion as to each party’s obligations.
- Investigating: Before we file a lawsuit, we take steps to preserve and collect any evidence available. These evidence include police accident reports, video footage and photographs of the accident, photos of the aftermath, eyewitnesses’ oral or written statements, public records to investigate the commercial vehicle driver and commercial vehicle company’s backgrounds, look over police and accident reports, interview medical staff, recreate the accident with experts, make sure any critical evidence is not destroyed by vehicle driver and/or company, test commercial driver for alcohol and drugs, as well as get ahold of the vehicle’s Electronic Control Module (ECM), more commonly referred to as “black box.”
- Hiring Experts: Depending on the information we gathered on your case, experts may be needed to provide additional support for your claim for compensation. Experts include but not limited to medical, vocational, accident reconstruction, commercial vehicle expert, financial, and economic.
